These are the terms of use for DepoGenius.com, the software that helps you get more from depositions quickly.
Thank you for using DepoGenius.com! These Terms of Use apply when you use the services of DepoGenius, Inc. or our affiliates, including our application, software, tools, developer services, data, documentation, and websites ("Services"). The Terms include our Service Terms, Usage Policies, Privacy Policy, and other documentation or policies we may provide in writing. By using our Services, you agree to these Terms.
You must be 13 years or older to use the Services. If you are under 18 you must have your parent or legal guardian's permission. You must provide accurate information to register and are responsible for all activities with your credentials. You are responsible for keeping your login credentials secure and confidential.
You may access and use the Services only in compliance with these Terms and applicable laws. DepoGenius and its affiliates own all rights to the Services. You grant DepoGenius a worldwide license to use any feedback or suggestions you provide to improve our products and services. You may not: (i) infringe on others' rights; (ii) reverse engineer our Services; (iii) develop competing products using our Services; (iv) scrape, harvest, or extract data from our Services; (v) represent AI-generated content as human-generated; (vi) resell API access without permission; or (vii) submit unlawful content. You must comply with rate limits and requirements in our documentation.
You own any original content you submit. DepoGenius may use it to provide the Services. AI-generated content may not be unique across users. We do not claim ownership of similar content generated for other users. We may use non-API content to improve our models and services. You can opt out by making this request via email if you do not want your content used this way.
Certain features of our Services use artificial intelligence and machine learning to analyze documents, generate reports, and provide insights ("AI-Generated Content"). You acknowledge and agree that: (a) AI-Generated Content may contain inaccuracies, omissions, or errors. AI systems can produce results that appear plausible but are factually incorrect, incomplete, or misleading. (b) You are solely responsible for independently verifying all AI-Generated Content against original source materials before relying on it for any purpose, including but not limited to legal strategy, filings, client communications, or court proceedings. (c) AI-Generated Content does not constitute legal advice, legal analysis, or any form of professional counsel. DepoGenius is a technology tool, not a law firm or legal services provider. (d) DepoGenius expressly disclaims any liability arising from decisions made, actions taken, or omissions based on AI-Generated Content. You assume all risk associated with the use of AI-Generated Content. (e) AI models may produce different results when processing the same inputs at different times. Consistency of output is not guaranteed.
To use our Services, DepoGenius will provide an estimated cost based on the usage. Clients are responsible for maintaining a sufficient balance to cover the estimated costs of their activities. DepoGenius reserves the right to reject requests that exceed the available balance in your account. Detailed pricing information is available on our website.
You will protect any confidential information we provide per our instructions. You agree to implement reasonable security measures when using our Services. If using our Services to process personal data, you represent compliance with applicable data protection laws. Please request our Data Processing Addendum if applicable.
These Terms remain in effect until terminated by either party. DepoGenius may suspend or terminate Services immediately for legal reasons, security risks, fraud, or material breaches.
THE SERVICES ARE PROVIDED "AS IS." WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, TO THE EXTENT PERMITTED BY LAW. OUR LIABILITY UNDER THESE TERMS IS LIMITED TO THE GREATER OF THE FEES PAID IN THE 12 MONTHS BEFORE THE INCIDENT OR $100.
You agree to informal resolution attempts and arbitration of disputes. Class actions are prohibited.
These Terms are governed by Delaware law. DepoGenius may modify these Terms by posting changes on our website. You consent to receive legal notices by email. The Terms make up the entire agreement between you and DepoGenius.
